Madarassy – v – Nomura International plc* This case has provided a useful and keenly sought interpretation of the burden of proof guidelines in the Sex Discrimination Act.
Bell Yard advised Nomura following the Court of Appeal judgment and the May 2007 House of Lords decision in relation to this long-running unfair dismissal and sex discrimination dispute. Nomura was successful in defending its reasons for dismissing Ms Madarassy before three courts (Employment Tribunal, Employment Appeal Tribunal and the Court of Appeal) and the final result of this case left the Court of Appeal ruling standing, given the House of Lords declined to hear Ms Madarassy’s further submissions.
