Credit Crunch Litigation: When the London branch of a foreign bank found itself in dispute with a high-profile individual trader client counterclaiming negligence and regulatory breach (in response to a claim for non-payment of fees), it turned to Bell Yard for assistance on the litigation's reputational aspects. We concurred that certain ingredients existed to make the case media-worthy and that there was a potential risk to the bank's solid reputation among private clients should the bank's claim fail. So, we worked with the legal team to anticipate the storylines that might accompany the various potential legal outcomes and developed associated rebuttal statements. These were to be deployed should the aggrieved defendant choose to alert the media to the litigation. In the event, our client received a favourable judgment and limited media coverage, and was sufficiently well prepared to give a clear statement to media, staff and clients explaining the context to the dispute and the bank's vindicated position.
