Malcolm Perry* - v - Dresdner Kleinwort: Bell Yard acted for Malcolm Perry, an Australian, in his Race Discrimination and Unfair Dismissal claim against Dresdner Kleinwort. Incidences of discrimination are usually far more subtle than the direct replacement of one individual for another on the grounds of race. Bell Yard sought to publicly position Mr Perry's dismissal as a result of not being 'German enough' - ie that his dismissal was not based on performance but because he was neither German or German-speaking - and achieved wide-spread coverage of his claim during the hearing's opening days.
Although the Tribunal found that that Mr Perry had not managed to prove racial discrimination, Bell Yard worked closely with the media to ensure that journalists understood the reasons behind Mr Perry's claim and managed to achieve early correction of the seemingly disingenuous position of the defendants.
Mr Perry’s successful claim of unfair dismissal was prominent in the resultant coverage, which also made significant use of quotes from the statement drafted and issued by Bell Yard.
