Madarassy - v - Nomura International plc*: Bell Yard advised Nomura following the Court of Appeal judgment and the May 2007 House of Lords decision in relation to this long-running unfair dismissal and sex discrimination dispute. Nomura has been successful in defending its reasons for dismissing Ms Madarassy before three courts (Employment Tribunal, Employment Appeal Tribunal and the Court of Appeal) and the final result of this case leaves the Court of Appeal ruling standing, given the House of Lords declined to hear Ms Madarassy’s further submissions. This ruling provided greater clarity for future claims of discrimination.
This case has provided a useful and keenly sought interpretation of the burden of proof guidelines in the Sex Discrimination Act. Bell Yard was responsible for managing the information flow to the media and positioning the outcome, whilst making every effort to limit the reach of the allegations Ms Madarassy regularly sought to promulgate.
